Adult Unlimited Membership Agreement
This Agreement ("Agreement") is entered into on [Date], by and between Steps BJJ, located at 13635 Burbank Blvd, Sherman Oaks, CA 91401, hereinafter referred to as the "Academy," and the undersigned member, hereinafter referred to as the "Member."
This Agreement establishes the terms and conditions for the Adult Unlimited Membership at Steps BJJ. By signing this agreement, you acknowledge your understanding and agreement with the terms outlined herein.
1. Parties:
STEPS BJJ and the Member agree that by signing this agreement you purchased an Adult Unlimited Membership and agree to all the terms in this agreement. The Member also agrees to follow Steps BJJ membership policies and any academy rules.
2. Membership:
2(a). Nature of Membership: The Adult Unlimited Membership permits the Member to attend all the classes specified for the Adult Unlimited Membership plan. The schedule is available on the website STEPSBJJ.com. The membership is nontransferable, and it gives the Member no rights in Steps BJJ, its management, property, or operation. Steps BJJ may transfer the membership in its sole discretion. Steps BJJ can sell memberships at different rates and terms than yours. It is the Member's responsibility to notify Steps BJJ of any change in their address or phone numbers & billing information. The Member must have the correct training attire and equipment while attending classes.
2(b). Membership Freezes: The Member is eligible to freeze the membership for up to two months out of the year. Military personnel may freeze their membership for any period based upon a letter from their command showing orders that would deem continuing the membership unreasonable.
3. Financial Policy:
You agree to pay the monthly dues for the Adult Unlimited Membership. The initial monthly dues are $150 plus an $80 membership fee for the first 30 members, including a free Rash Guard.
Starting from the 31st member, the monthly dues will be $180 plus the $80 membership fee, including a Steps BJJ T-shirt. The Membership Term starts from the date stated at the bottom of this page. Regardless of facility or class attendance, the Member must pay monthly dues. An administrative fee of $15 will be charged for any returned check or debit problems, such as non-sufficient funds, a closed account, frozen or declined credit, or similar circumstances.

4. Representation – Entire Agreement and Enforcement:
You acknowledge that neither STEPS BJJ, nor anyone else, made any representations nor promises upon which you relied that are not stated in this agreement. If a court declares any part of this agreement invalid, it will not invalidate the remaining parts which continue unaffected. If STEPS BJJ does not enforce any right in this agreement for any reason, STEPS BJJ does not waive its right to enforce it later.
5. Cancellation, Termination, Refund:
5(a). Your Five-Day Cancellation Right: You, the Member, may cancel this agreement at any time before midnight on the 30th business day after the date of this agreement, excluding Sundays and holidays.
5(b). Cancellation Policy: Membership Students are required to give 30 days' notice (30 business days) before the next due payment to cancel the membership. Failure to do this will not cancel the next required monthly dues/payment.
5(c). Cancellation Rights: Membership fees are non-refundable. You may cancel this agreement and receive a refund of unused prepaid dues as follows:
5(c)(1). Disability or Death: Your disability must physically prevent you from attending the classes, and a licensed physician must verify this fact in writing. In the case of death, your estate must provide written evidence.
5(c)(2). Change of Residence: Your move must be more than 25 miles from Steps BJJ. A move fee of $100 will be deducted from any prepaid dues before dues are refunded.
5(c)(3). Notice and Effective Date: You (your estate) must send written notice and proof of the event within 30 days after it happens. Cancellation is effective as of the date of the event or the last time you attended Steps BJJ, whichever is later.
5(d) Termination Without Cause by STEPS BJJ: STEPS BJJ reserves the right to terminate your membership for any reason not stated above and is not prohibited by law. If STEPS BJJ does, it will mail a termination notice to you and refund any unused prepaid dues.
5(e) Termination on Academy Closure or Move: If Steps BJJ permanently closes or moves more than 25 miles from your residence, this agreement ends 30 days later. As such, you will not have to pay further monthly dues, and Steps BJJ will refund any prepaid dues.
6. Notice of Cancellation:
You, the Member, may cancel this agreement at any time before midnight on the 45th business day after the date of this agreement, excluding Sundays and holidays. To cancel this agreement, email or deliver a signed and dated notice or send a telegram stating that you, the Member, are canceling this agreement. The notice shall be sent to Steps BJJ at 13635 Burbank Blvd, 91401 Sherman Oaks, CA. Email: stepsbjj1@gmail.com
7. Media:
By entering into this agreement, the undersigned grants the school permission to use photographs, videotapes, artwork, or other likenesses of the Member for marketing, trade, publishing, or any other lawful purpose.
8. Arbitration:
If there is any dispute or claim between you and Steps BJJ involving an amount in controversy of more than five thousand dollars, you and Steps BJJ agree to submit the dispute for resolution to binding arbitration. Arbitration means that neither you nor Steps BJJ can sue each other in court over a dispute, and that a neutral arbitrator will decide the dispute, not a judge or jury. This arbitration provision is governed by the Federal Arbitration Act (FAA).
I have read and understood this agreement in its entirety. I acknowledge that I am signing this contract freely and voluntarily.

Liability Waiver
1. Health Representation: You declare to be in good health and agree to notify STEPS BJJ of any changes during your membership.
2. Consent to Physical Contact: Physical contact may be used for instruction, and you give full consent as customary in Brazilian Jiu-Jitsu training.
3. Waiver: In consideration of participation, you waive and release STEPS BJJ and its staff from any liability for personal injuries or damages resulting from program activities, on or off the facility's premises.
