Membership Agreement and Terms - STEPS BJJ

This agreement outlines the terms and conditions for membership with STEPS BJJ, a dedicated Brazilian Jiu-Jitsu academy located at 13635 Burbank Blvd, 91401 Sherman Oaks, CA. By following and signing the clauses below, you indicate your agreement and commitment to the academy's policies, including small rules for coexistence and the preservation of common areas. Please read carefully and fully understand the terms before signing.

1. Membership Terms:

STEPS BJJ offers various membership plans, and it is your responsibility to notify the academy of any changes to your address, phone numbers, or billing information. Proper attire and equipment are mandatory during classes, and changes may be requested if the attire is not suitable for the chosen class.

2. Representation - Entire Agreement and Execution:

You acknowledge that this agreement constitutes the entire understanding between you and STEPS BJJ. If any part is deemed invalid by a court, the remaining portions remain in effect. Failure by STEPS BJJ to enforce any right does not waive the right to enforce it later.

3. Financial Policy:

You agree to pay the dues for the specified membership period. Minors under 18 require payment guarantee from an adult. Dues must be paid monthly, regardless of facility use. A $15 administrative fee will be applied for returned checks or debit issues.

4. Membership Freeze:

You can freeze your membership for up to two months per year. Military personnel can freeze with appropriate documentation. We request a 30-day notice with departure and return dates to ensure no charges are made during this period, ensuring both your and our establishment's proper arrangements.

5. Cancellation, Termination, Refund:

5(a). Five-Day Cancellation Right:You can cancel this agreement within the first five business days, excluding Sundays and holidays, in case of withdrawal.

5(b). Cancellation Policy:Members must provide a 30-day notice before the next payment to cancel the membership.

5(c). Cancellation Rights:Membership fees are non-refundable, except for the following exceptions:

• 5(c)(1) Disability or death, verified by a licensed physician or proof of death.
• 5(c)(2) Moving more than 25 miles from STEPS BJJ, subject to a $100 change fee.
• 5(c)(3) Notice and proof required within 30 days after the event.

5(d) Termination without Cause by STEPS BJJ: STEPS BJJ reserves the right to terminate your membership for any reason not stated above, with notice of termination and refund of unused prepaid dues.

5(e) Termination due to Academy Closure or Move: If STEPS BJJ permanently closes or moves more than 25 miles from your residence, the agreement ends 30 days later, with no further monthly dues, and STEPS BJJ will refund any prepaid dues.

6. Notice of Cancellation:

You can cancel this agreement within the first forty-five business days by sending an email or delivering a signed and dated notice to Steps Bjj, 13635 Burbank Blvd, 91401 Sherman Oaks, CA. By email: stepsbjj1@gmail.com

7. Media Release:

By signing this agreement, you grant permission for the use of your image for marketing, trade, publication, or any other legal purpose.

8. Arbitration:

Disputes exceeding $5,000 will be resolved through binding arbitration, governed by the Federal Arbitration Act (FAA).

9. Class and Membership Details:

• Classes: Unlimited Membership for Kids
• Monthly Fee: $120.00 + $80 sign-up fee (Promotional value for the first 30 Steps Bjj members. Regular value after the 31st sign-up will be: $150 + $80 sign-up fee. 
• Both include a free Kids Gi Uniform.)

Liability Waiver

1. Health Representation:You declare to be in good health and agree to notify STEPS BJJ of any changes during your membership.

2. Consent to Physical Contact:Physical contact may be used for instruction, and you give full consent as customary in Brazilian Jiu-Jitsu training.

3. Waiver:In consideration of participation, you waive and release STEPS BJJ and its staff from any liability for personal injuries or damages resulting from program activities, on or off the facility's premises.
